Assumption of Risk and Liability Release

Booking and Cancellation Policy

TODAY'S DATE: July 31, 2025

1.) No Insurance policy or coverage of any kind is provided in connection with this contract.

2.) No pets allowed on tubes, No pets allowed on shuttle bus. No exceptions. Expect a $150 fee charged to your credit card for non-compliance.

3.) All equipment rented from Little Outlaw Canoe, Tube, & Kayak Rentals; Rich Inc.; will remain the property of the firm, and must be returned in the same condition as when received with ordinary wear expected. Ordinary wear does not include equipment damaged by attempting to navigate Rocky Ford Rapids at Rock Dam on the Niobrara River.

4.) Renter agrees to pay for loss or damage to canoes, not to exceed $2600.00 per canoe, loss or damage to kayaks not to exceed $1300.00, loss or damage to tubes not to exceed $250.00, loss or damage of paddles not to exceed $105.00 each, loss or damage to life jackets not to exceed $85.00 each. This includes damage of any equipment while attempting Rocky Ford Rapids at Rock Dam and Fritz Island Rapids on the Niobrara River.

5.) Renter agrees to pay and reimburse Little Outlaw Canoe, Tube, and Kayak Rentals; Rich Inc. for any and all legal fees and costs incurred to collect losses or damages, or to enforce any terms and conditions of this Rental Agreement.

6.) Renter agrees that if any person less than eighteen (18 ) years of age uses any canoes, tubes, kayaks, tanks, or any other equipment provided by Little Outlaw Canoe, Tube, & Kayak Rentals; Rich Inc., The renter expressly assumes all risks and responsibility for possession and use of such equipment by such minor(s) as the parent(s) and/or natural guardian or other responsible party for such minor(s) and all provisions of this Rental Agreement and Assumption of Liability shall be binding and enforceable against such party by reason of the minor(s) use of such equipment.

7.) Equipment will not be used on the water before sunrise or after sunset.

8.) Renter is aware of the portage at Rocky Ford Rapids at Rock Dam on the Niobrara River, and agrees to carry all equipment around the Rock Dam if the destination is beyond the portage. Any persons witnessed and/ or attempting to navigate the Rocky Ford Rapids with any and all equipment owned by Little Outlaw Canoe, Tube, and Kayak Rentals; Rich Inc., will be charged $300.00 immediately to the credit card provided for the rental/ or reservation. This fee will not include any cost for damage(s) to the rental equipment, the damage fee will also be collected as repairs are assessed.

9.) In renting equipment, the Renter assumes all risk and responsibility for possession and use of the rental equipment and Little Outlaw Canoe, Tube, and Kayak Rentals; Rich Inc., disclaims any and all liability for damage, loss, or injury, whether to persons or to property, from the Renter(s) use and possession of the rental equipment. Renter further agrees to indemnify Little Outlaw Canoe, Tube, and Kayak Rentals; Rich Inc., and hold them harmless from any loss, expense, damage, claims, actions, causes, or cause of action arising directly or indirectly from the rental of said equipment.

10.) In the event any equipment would be used on the USFWS Ft. Niobrara Wildlife Refuge the Renter agrees to indemnify Little Outlaw Canoe, Tube, and Kayak Rentals; Rich Inc., for any violations, actions, or cause of actions related to rental of said equipment.

11.) Although the Scenic Niobrara River offers a relaxing locale for our guests, river activities can be physically demanding at times. Persons of advanced age, infants, and persons with health restrictions which may limit their capacity for physical exertion are advised to not participate in any of our river trips. The Renter by execution of this agreement expressly agrees and represents that he (she) as well as any other persons in his (hers) party have been advised of the forgoing and that they are all physically able to undertake and complete such trip. The undersigned Renter does hereby expressly agree to hold harmless and free from all liability Little Outlaw Canoe, Tube, & Kayak Rentals; Rich Inc., Richard S. Mercure, their employees, officers, volunteers, agents, assigns, heirs, or personal representatives from any and all claims, or causes, or action which may arise hereafter by reason of death, injury, and or illness of any persons while participating in this recreational activity with Little Outlaw Canoe, Tube, and Kayak Rentals; Rich Inc., or on the Niobrara River.

12.) Little Outlaw Canoe, Tube, and Kayak Rentals; Rich Inc. is a Rental Livery Equipment provider, for Niobrara River Recreation, and will not be liable for any claims, or cause of action associated with rental of any and all equipment.

13.) Customers, Clients, and Guests are allowed to make a portage at Rocky Ford Rapids if the trip destination is beyond the Rock Dam.  Rocky Ford Outfitters is privately owned, loitering and landing rental equipment is strictly prohibited and will be assessed a $55 per vessel fee. 

14.) Our shuttle buses run on a on time schedule. If you miss a scheduled shuttle bus, and still desire to float, a special shuttle bus fee of $50 will be required. 

Booking and Cancellation Policy:

All Guaranteed Bookings must be held with a verified Credit Card. All Online Bookings require full payment and will be guaranteed at the time of booking.  

Cancellation Policy: (1) If we cancel the trip we will reimburse your full payment. (2) If you cancel the trip for any reason; Because we have taken equipment to be reserved out of our inventory, and held it for you, these terms apply:

Cancellations up to 14 days in advance will be refunded less a 25% booking fee, or can be rescheduled in the current season. Cancellations from 13 to 8 days in advance of the trip will be refunded less a 55% booking fee, or may be rescheduled in the current season. Cancellations 7 days or less will receive no refund and no rescheduling of trip allowed.
